Musk vs. Altman: The Trial That Could Break OpenAI

The trial everyone in tech has been waiting for finally kicks off this week. Elon Musk is going head-to-head with Sam Altman in a courtroom, and the outcome could fundamentally change how OpenAI operates.

Musk’s argument is straightforward: OpenAI, under Altman, abandoned its original nonprofit mission to ensure AI benefits all of humanity, not just wealthy investors. He was an early donor and advisor, so he has some standing to make that claim. But let’s be honest, this is also personal. Musk left OpenAI years ago, and watching Altman turn it into a commercial juggernaut has clearly been rubbing him the wrong way.

It’s easy to dismiss this as two billionaires fighting over their egos, and sure, there’s plenty of that. But the real stakes are much higher. If Musk wins, OpenAI’s ability to run a for-profit arm that funds its nonprofit research could be severely restricted. That profit engine is what lets them throw billions at training models like GPT-5 and beyond. Without it, the nonprofit doesn’t have the cash to compete.

Even more drastic: the lawsuit could force Greg Brockman and Sam Altman out as officers. Altman could also lose his board seat. That would be a massive shakeup at a company that’s already had its share of chaos.

I’ve seen a lot of insider chatter suggesting that trust in Altman’s commitment to the mission is eroding internally. This trial will put that tension on full display. Whatever happens, the AI landscape is going to look different when it’s over.
